Indiana is the state that actually enacted an HRA incentive: IC 6-3.1-38 (HEA 1004-2023, amended by HEA 1210-2026 retroactive to January 1, 2026) gives employers with fewer than 50 employees that adopt an HRA in lieu of a traditional group plan a nonrefundable credit — the lesser of the actual contribution or $400 per covered employee in year one, $200 in year two — under a $10M statewide annual cap, with a 10-year carryforward and, for taxable years after 2025, pass-through owners claiming their share. The statute defines the HRA by reference to IRC §9831(d), so confirm with your tax adviser that your arrangement type qualifies (as of August 2026).
